Right of withdrawal

1. Who and what does this notice cover?

The statutory right of withdrawal is available to consumers only. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 BGB, German Civil Code). Businesses have no statutory right of withdrawal.

This notice applies to paid contracts concluded at a distance (Section 312c BGB), that is via the website, the dashboard or by e-mail, without both sides being physically present at the same time.

2. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us

of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

3. Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Reimbursement takes the same route as the payment, for both products via Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Dublin 2, Ireland. How long the credit takes to show up at your bank or payment provider is outside our control.

Once the withdrawal takes effect, the right to keep using the service ends:

• For the Premium subscription, the server in question falls back to the free feature set. The bot keeps working; the Premium limits and Premium features are gone.
• For the MXO Live Studio subscription, access ends. Your data remains available for another 30 days so that you can export it; after that it is deleted.

4. Compensation for value if performance starts early

If you requested that the service should begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your exercise of the right of withdrawal from this contract, in comparison with the full coverage of the contract.

This concerns both subscriptions: if the service is unlocked immediately – Premium for the bot, your own instance for the Studio – it is usable from that moment on and is charged pro rata.

Compensation for value can only be claimed if you expressly requested the early start and were properly informed about the right of withdrawal beforehand (Section 357a BGB). If either is missing, you owe nothing.

Compensation for value can at most be the amount attributable to the days up to your withdrawal – never more than the fee for the current month. We do not charge any further costs, for instance for setting up your instance.

5. Early expiry of the right of withdrawal

All three products are ongoing services, not digital content for download. The relevant rule is therefore Section 356(4) BGB and not Section 356(5): the right of withdrawal expires only once the service has been fully performed and we only started performing after you gave your express consent and at the same time confirmed your knowledge that you lose your right of withdrawal once the contract has been fully performed.

A subscription that can be cancelled monthly is not fully performed within the first fourteen days. Your right of withdrawal therefore remains for the full fourteen days for both products. Only the pro-rata compensation described in section 4 applies.

5.1 Why we provide immediately

During checkout we expressly ask you to let us begin performance immediately, and we point out the consequence: you can use the service straight away, but on withdrawal you owe pro-rata compensation for the days up to your withdrawal. Without that consent you owe no compensation for value (Section 357b BGB).

That consent does not cost you your right of withdrawal. That would only be the case for digital content supplied for download – and we do not hand that out.

5.2 Free basic use

Free use of the MXO Discord Bot is not a contract for consideration. There is no right of withdrawal there, and consequently none that could expire. You can remove the bot from your server at any time.

6. Model withdrawal form
